I'm just so frustrated I could scream honestly. I work as a cashier at a grocery store in Highland, and about two months ago I was walking from the front of the store to the back to grab something from the stockroom when a pallet that someone had left in the aisle shifted and I tripped over it. Went down hard on my knee and ended up with a torn meniscus that needed surgery. I reported it right away, filled out all the paperwork, and thought it was pretty clear-cut because it happened during my shift, on the clock, inside the store. Then last week I got a letter from the insurance company saying they were denying my claim because they claim I wasn't doing anything work-related when I fell, which makes zero sense since I was literally walking to do my job. My manager was even there when it happened and saw the whole thing. I feel like they're just hoping I'll give up and go away because I'm not someone who's going to make a big stink about it. But I can't afford to pay for this surgery and the physical therapy out of my own pocket, especially since I've been out of work recovering. My dad retired from the state police and he said that insurance companies pull this kind of thing all the time and that I should stop trying to deal with them myself because they're never going to take me seriously. He found a Highland NY Workers Compensation Attorney for me to call and said I need to let someone who knows how to fight these people handle it because I'm just going to keep running into walls on my own. I guess I'm just venting here because I never thought I'd be in this position—I did everything right and I still ended up with a denial letter. Has anyone else had a claim denied for something that clearly happened at work? How did you get it overturned?
